One Year On

Wow time flies, a year ago, the public notice of the winding up application against Kate McIver Skin went up on 9th March in The Gazette and the official order was granted on 19th March to close them down due to non payment of debt.

It was real tough for me and my family during the actual legal battle period which went from 2023 to summer of 2024. Honestly, I never thought that I could get through that very challenging period as I was extremely stressed with money worry, more importantly I struggled to put food on the table to feed my family being the only wage earner. Thanks to my young man, guardian angels, customers and friends I survived and my business is thriving too!

It was never my intention to go through the whole legal process as I offered to settle it out of court several times without success. I was absolutely livid when KMS turned round asking me to settle it by PAYING THEM £50,000 with no conditions!!!!! They should be giving me an offer of payment. Shocking isn't it?

I lived by strong principles in that I always respect others and never harm anyone. Also I am a stronger believer of karma as it always catch up with those who hurt others and it did with KMS.

Over the past two years, I have received hundreds of supportive messages & comments, many are from ex customers of Kate Mclver Skin and yesterday I received a brilliant comment on Instagram:

"I just read your case for my Masters in Law and the only thing I can really think about now is that I want to buy your serum 🩵"

Absolutely brilliant to hear that my ground breaking legal winning case is being studied by law students and it's only one year ago!!!. Yes my winning in Reverse Passing Off is the FIRST case ever determined by trials in the UK. Basically my winning case has set the precedent for all future legal actions in Reverse Passing Off and intellectual property theft. I also won 2 out of the 3 criterias for Malicious Falsehood against Kate Eleanor McIver so malice was established.

I feel so blessed the truth is out that I am the creator of Elixir but most of all I never gave up the fight to take back my creation against a big company. KMS became a big company making lots of money by selling Secret Weapon aka my Elixir. I believe they thought by dragging the legal battle so long ( 5 years) that I would go bankrupt, however the one who went bankrupt was them, karma indeed!

The moral of this story is that crime never pays!
